Using this site

These terms govern your use of givemaxlife.com (the "Site"), run by Max Life Charity Inc ("Max Life Foundation", "we", "us" or "our"). By using the Site or making a donation, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.

About us

Max Life Charity Inc is a nonprofit organization recognized as tax exempt under Section 501(c)(3) of the Internal Revenue Code. Our mission is to help families affected by pediatric cancer through grants.

Donations

Payments. Donations are processed by Stripe, and Stripe's own terms apply to your payment. You confirm that you are authorized to use the payment method you provide.

Use of funds. Every donation is an unrestricted gift to Max Life Charity Inc and is used at our discretion to further our charitable mission. A gift made in honor of someone or credited to a team is recognized that way, but this does not restrict how it is used or direct it to any particular family.

How funds are held. We currently hold donations in our bank account. We intend to move them into high-yield stablecoin accounts or other interest-earning holdings and to use the income to fund grants. Holdings may earn little or no interest, and some carry risk, including loss of value. We do not promise any rate of return, any grant amount or a grant to any particular family.

Tax deductibility. Donations are tax deductible to the extent permitted by law. No goods or services are provided in exchange for a donation. Please keep your receipt and ask a tax advisor about your own situation.

Monthly donations. A monthly donation is charged on about the same day each month until you cancel it. You can cancel at any time through the billing portal or by emailing us. Cancelling stops future charges but does not refund past ones.

Refunds. Donations are generally not refundable. If you think a donation was made in error, contact us within 30 days and we will review your request in good faith.

Recognition. Donations appear on our public dashboard as described in our Privacy Policy. Leave the name field blank to give anonymously.

Teams and fundraising

You may create a team and share its code to raise money for the foundation. What you enter must be accurate, lawful and respectful. Only name a person you are honoring if you have the right to do so. Do not impersonate anyone. Team creators are volunteers, not our employees or agents, and may not collect money on our behalf except through the Site. We may edit or remove any team or content at our discretion.

Acceptable use

You agree not to:

• use the Site for anything unlawful, fraudulent or harmful, including testing stolen payment cards;
• post content that is false, offensive or infringes anyone's rights;
• interfere with the Site, its security or other people's use of it;
• collect other people's information from the Site to contact or harass them.

Our content

The Site's text, images, logos and design belong to us or our licensors. You may view and share them for personal, non-commercial purposes, such as telling others about the foundation. Content you create and share with the #givemaxlife hashtag remains yours.

Not medical advice

Information on the Site and on the resources we link to is general information only. It is not medical, legal or financial advice. Always seek the advice of a qualified professional about a child's health.

Other sites

The Site links to services we do not control, such as Stripe and our resources page. We are not responsible for their content or practices.

Disclaimer

The Site is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent the law allows. We do not promise that the Site will be uninterrupted or error free.

Limitation of liability

To the fullest extent the law allows, Max Life Charity Inc and its directors, officers, volunteers and service providers are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred US dollars.

Indemnity

You agree to hold us harmless from claims arising from your misuse of the Site or your breach of these terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be heard in the state or federal courts located in Miami-Dade County, Florida.

General

We may update these terms by posting a new version here with a new date. Using the Site after an update means you accept it. If any part of these terms cannot be enforced, the rest remains in effect. These terms and our Privacy Policy are the entire agreement between you and us about the Site.
